Indiana's Inspector General Continues to Cover Up Crime

Something that INDY REPUBLICAN and all right thinking Hoosiers figured out long ago is, that in this state the powers that be enforce the laws only when they wish to. Since 2005 when "Godfather Governor" Mitch Daniels created the office of Inspector General to cover up investigate and ferret out wrongdoers. The amount of criminal activity and corruption has exploded a thousand fold in this state. Earlier this week one of IR's favorite Indiana journalists Kara Kenney had an outstanding story about a Department of Corrections Supervisor accused of running a business on state time:

The Inspector General’s office launched an investigation in October 2018 following a complaint about a Department of Correction supervisor selling essential oils during work hours.

According to the complaint, an IDOC employee told investigators the supervisor approached her about selling products during an IDOC meeting and gave her a product sample.

“Employee also indicated that she saw another DOC employee give the supervisor money during state time for what she assumed was payment for the purchase of essential oils,” read the OIG report. “Employee alleged that the supervisor recruited at least three other DOC employees to sell the products.”

In an interview with an OIG investigator, the supervisor said she began offering and promoting products through a private company during the fall of 2017, but stopped when IDOC launched an internal investigation.

The supervisor also said three of her Department of Correction subordinates joined the company and engaged in the business outside of work.

The OIG investigation found the IDOC supervisor received a percentage of the application fee for the three IDOC employees who obtained company memberships through her.

IDOC investigators found an email the supervisor sent from her state email related to the essential oils business.

“Although the investigation revealed the supervisor engaged in limited misuse of state property and a violation of DOC policy, her misuse of state property was low in volume and spread over a time frame of several months,” read the report.

The Office of Inspector General found “insufficient evidence” to bring a formal complaint against the IDOC supervisor before the State Ethics Commission.

“The evidence did not clearly show how much state time the supervisor spent promoting or offering products because some of this activity occurred during the supervisor’s lunch hours and after state work hours,” read the OIG report, dated May 23.

But fear not fellow hoosiers! Because even though the IG has declined to bring a formal complaint against the IDOC employee who by their own admission engaged in a commercial venture on state time. An offense that could get an employee terminated by the state. The IG has agreed to take the following action so that they not be forced too often to pretend to investigate wrongdoing at the state:

The OIG recommends the Indiana Department of Correction distribute a written notice to all IDOC employees reminding them that if they engage in any outside business, they must do so on their own time without using state time or state property/resources.

The Inspector General also recommends IDOC and its supervisors use caution when talking to subordinates about outside businesses they’re involved in.

Yeah have IDOC actually explain to DOC employees that they aren't supposed to engage in outside business on state time. That'll teach people not to commit ghost employment! As for recommending that IDOC and the supervisors their us caution when discussing outside business at DOC. Why not just tell them NOT to talk to anybody at work about outside employment? You know due to something called common sense and professionalism.

Lastly the Inspector General's office had this final bit of Solomon-like wisdom to offer the DOC:

“The OIG encourages DOC to consider providing additional training or instruction for all DOC employees in supervisory or managerial roles on the ghost employment and use of state property rules,” read the report. “Employees in authoritative positions often have the ability to wield undue influence over their subordinates, even if unintentional.”

Our response to the IG is "No Shit"! There are single celled organisms that know that people in authority have the ability to wield undue influence over their employees. Kudos to Kara Kenney for this outstanding report. Feel free to read the IG's so called report here if you wish. This reminds us all here of a similar case of blatant ghost employment reported on by Kenney back in 2012. Both Gary Welsh and Paul Ogden blogged about the case at that time. Paul Ogden had this interesting observation of that case:

Let me get this straight.  I write a memo to the Commissioner of the Indiana Department that my supervisor was misappropriating money from the title insurance division that I ran and committing other legal violations.  Within minutes of getting that memo, I am immediately fired and left two years short of my pension.  I'm not alone.  Whistleblowers who are routinely fired by the state and I am not aware of a single one who has ever prevailed in court. Judges do not enforce the laws protecting state employee whistleblowers.  

If you are a state employee who dares to report ghost employment, the whistleblower can expect to be fired and have absolutely no recourse.  Meanwhile the state employee who commits the ghost employment gets a short suspension and continues on in state employment or gets his full pension should he choose to retire. 

In the interest of saving taxpayers money at this point the Indiana General Assembly should just abolish the Inspector General's office. After 14 plus years of existence it has only served to shield wrongdoers from being held accountable. And to punish those employees who have tried to uphold the laws and protect the taxpayers money. In the past the IG has used their office to cover up and protect former Indiana Secretary of State and Congressman Todd Rokita. The administration of former Governor Mike Pence further allowed the Inspector General's Office to cover up wrong doing by a former BMV official.

Given the track record so far of Governor Eric Holcomb we can expect more, not less of these incidents to occur. Seeing as Holcomb is a servant to his demonic master Mitch Daniels it is not surprising that he has appointed Daniels flunky Lori Torres to the post of Inspector General. Torres was Commissioner of the Indiana Department of Labor for part of Daniels time as Governor. So naturally she has continued to do the bidding of her masters in hoosier politics. What we suggest to our readers is that they write, call and email Ms. Torres and her office until she decides to actually do her job. Also contact Governor Eric Holcomb, as well as your state legislators about this. Tell them that Gary Welsh called and he wants to give them all an earful.

Rokita's Ethics Problems are Much Worse Than you Think

INDY REPULICAN's least favorite Indiana Congressman just cannot seem to stop getting his hands caught in the cookie jar as Rokita wrongly decrees he is legally allowed to steal the cookies. Just as the "laughbox" is activated for sitcoms, Hoosier voters are repeatedly fed words such "unsubstantiated", "de minimus" and 'we received a private and secret ethics opinion' overtime Rokita is caught blowing money like a drunkin' sailor to promote himself and support his campaigns while allegedly "working" at his so-called "duty station".  Last Friday Brian Slodysko reportedthat when Rokita was Indiana Secretary of State that the Indiana GOP had locked him out of their donor database back in 2009.

Slodysko reports:

Todd Rokita likely violated ethics laws as Indiana's secretary of state by repeatedly accessing a Republican donor database from his government office, prompting party officials to lock him out of the system until he angrily complained, three former GOP officials told The Associated Press. The alleged ethics flap over Rokita's use of the Indiana Republican Party's Salesforce database during work hours occurred in 2009, as he was wrapping up a second term as the state's chief elections official and angling for higher office. Indiana law prohibits state employees from engaging in political activity while on duty or acting in an official capacity. It also prohibits work on anything outside official duties while on the clock, or ordering others to do so, and from using state resources for political purposes. The former officials, who have direct knowledge of the situation, spoke on condition of anonymity because they are not authorized to talk about it publicly. They did not report Rokita's activity to authorities at the time.

(While the above sources had not filed complaints, IR has learned complaints nonetheless had been filed against Rokita as far back as 2011 over the same issue and the Inspector General's Office still refuse to issue a response)

Rokita's campaign spokesman Nathan Brand said Thursday April 12th, 2018 that Rokita used the database to keep his personal rolodex, which Brand said was allowed under state ethics guidance the office received. However, Rokita's campaign could not produce documents outlining the guidance, and the office of current Indiana Secretary of State Connie Lawson said it could not locate any such records. State party officials were alarmed when they discovered that a computer in Rokita's Statehouse office frequently logged in to the database containing detailed campaign information on activists and donors. They froze his access to the system but restored it after Rokita complained. 

Slodysko also reports that mailers from the Secretary of State's Office were sent out to some county republican chairmen about Rokita's "Rethinking Redistricting" which garned a great deal of attention during Rokita's successful run for Congress in 2010. Two legal experts interviewed by Slodysko did not believe that Rokita's use of state resources and employees was legal. David Orentlicher a lawyer and former Democratic state legislator from Indiana said: "Using your government staff (for political business) during their work day, while they are using government resources? This is well across the line and not a hard call." Indianapolis attorney Bill Groth said he believes that Rokita or his employees were "engaging in unlawful political activity, the unlawful use of state property, and ghost employment." "Indiana law strictly requires elected state officials to wall off their public duties from political activities," Groth said.

Since the Secretary of State has NO STATUTORY POWER to draw legislative and congressional district lines, one has to question why Rokita spend thousands of dollars of taxpayer funds on a Rethinking Redistricting websites, promotional materials and a professionally made video shown at political dinners around the state in 2010. The expenditures constituted a bald-faced effort by Rokita to promote himself as he was trying to secure future "public employment" as his term of Secretary of State was winding down. Other politicians could be prosecuted for theft for the same actions.

We are very impressed with Brian Slodysko's article and we encourage everyone to go read the entire article. Slodysko should have asked these officials why they did not report Todd Rokita to the authorities.  Our readers may recall that we blogged in February of last year about former Indiana Schools Superintendent Tony Bennett's issues with misusing his office personnel and resources to try to get reelected to his job in 2012. In that post we also referred our readers to a post Gary Welsh over at Advance Indiana had made back in 2014 that discussed not only Bennett's problems but pointed out how Todd Rokita probably had very similar problems himself

The responses out of Rokita's camp sounds as if they have something to hide. The dearth of any substance in Rokita's attempt to defend themselves is nothing short of embarrassing. Here is what some others are saying about Rokita's response to AP's story:




As soon as this story hit the AP wire IR was immediately contacted by several of our sources stating that various government officials were aware or had been made aware of Mister Rokita's unethical, possibly criminal actions as far back as 2011 but that nothing was done about them. We find it impossible to believe that journalists in Indiana are only just now finding out about this. Here is just some of what we have heard about Rokita and the claim that his misusing his state office is a new revelation:


"The AP was informed that in March/April 2011 reports were made to the IG and to the Marion county prosecutor and no one cared" 


"AP was even given the name of the software platforms (campaign sales force and later backoffice) and the shared file the employees updated (for Todd Rokita) named “Lucy”

"Word around the water cooler was Curry’s chief deputy David Rimstidt back in 2011 was told by several people about Rokita’s indiscretions but did less than nothing."

Interestingly the late great Gary Welsh wrote here and here about Rimstidt on Advance Indiana in 2010. Rimstidt appears to be somewhat shady to many. 

“The Inspector General was asked back around 2011 if Rokita’s activities were not illegal nor unethical, that if they were in fact ethical and legal. You think they would have whipped the fantasy opinion out to show what they had sent to Rokita but they never got issued anything about Old Todd”

"Republican state committee people were up in arms when they found out he (Todd Rokita) was using campaign sales force and Rokita yelled at them when they turned off his account. He started using “backoffice” so the state party couldn’t monitor his use of office staff for this shit"

IR has been told by our sources that “Lucy” was the name of the shared file of the spreadsheet that Rokita would have his staff update names of donors, contact info, talking points for TR and the amounts of donations to other campaigns During his 2010 congressional run.These were spreadsheets he (Todd Rokita) used to keep information on whom to call for money when he was in the car. Our sources told INDY REPUBLICAN they haven’t the first clue where the "Lucy" file was kept. All that is known is that "Lucy" was accidentally found saved on the hard drive in the executive office in 2011. Many of our sources have been trying to find out why the file was called "Lucy" as one informant told us: "Kinda sticks in your head because you want to know “why did they call it Lucy?!”

If you feel a burning sensation in your wallet do not panic and hold on to it tight as it is only a warning that Rokita is near to feed his mammoth hunger for more ill-gotten money. Our sources also claim that Rokita received reimbursements and payments that he was not legally allowed to take:

"Rokita bragged in speeches around Indiana for eight years that he did not take a state car as Secretary of State, insinuating he was saving the taxpayers money.  What Rokita concealed from Hoosiers was that he was constantly receiving reimbursements for mileage from the State for use of his campaign car. Many in the State would argue it would have been better for Rokita to simply have his gas paid for using a state vehicle instead of mileage reimbursements."

"Rokita also received an extra paycheck and annual healthcare deposit by mistake from the State Auditor in January of 2011 as if he were Secretary of State while he was a congressman. Rokita of course refused to pay it back immediately unless he was first paid 11,000 for his “comp time” from when he was COS for Gilroy (even though the books had been closed for years for his time as COS for Gilroy). Executive Broadband employees do not get a check for past comp time after they vacate a particular position. Further, Rokita had previously denied other past executive broadband employees request for a cash reimbursement for comp time. Rumors were swirling about some “deal” he made to pay the money back in 2012 or 2013 before the board of accounts was starting to try to reconcile everything. For any other people, this would be theft."

INDY REPUBLICAN seriously doubts Todd Rokita got an ethics opinion on what he was doing with Salesforce. If he had received such an opinion publicly, Tony Bennett would have used it to defend himself. As our sources tell us “Rokita is only a master of using his staff for ghost employment. As Tony Bennett was slapped with ethics fines over the "red meat" list former Rokita staffer Cam Savage downloaded on public computers, many do not realize that Tony Bennett's action were naive child's play compared to the Rokita's."  All Hoosier taxpayers should challenge Rokita to produce his ethics opinion, whether issued publicly or privately, where the Inspector General made criminal ghost employment and theft of public resources suddenly legal just for him.

Ironic how ancient folklore even reveals Rokita to be a swamp creature, terrorizing hardworking Hoosier taxpayers all while he claims to be at his "duty station". If President Trump were still the host of the Apprentice, it would be funny to see the look on Rokita's face as Trump told him "You're Fired!"

Ex-BMV Offical's Ethics Wrist Slap or More Reasons why Indy Republican will not endorse Mike Pence!

In a story reported in today's Propaganda Rag Indianapolis Star by Tony Cook one of the only real reporters left at the Star. It is reported how former Bureau of Motor Vehicles Chief of Staff Shawn Walters and the Indiana State Ethics Commission have reached and agreement for Walters to pay a $500 fine for having violated state ethics law requiring a one year cooling off period for state employees who wish to leave state employment and go to work for a company that does business with the state. Yesterday the Star reported that Shawn Walters had come to a settlement between himself and Indiana Inspector General Cynthia Carrasco. And that the terms of the settlement would be revealed today. This whole sordid tale revolves around Walters having taken a position with Express MVA a company that had a contract with the state to charge "convenience fees" at BMV Express workstations that were double the costs of services usually charged at BMV branches. A class action lawsuit was settled last year for $30 Million after it was discovered that the BMV had been overcharging customers for several years. A news report in the Indianapolis Star back in May  2015 and a posting by Gary Welsh at the same time argued that political patronage was to blame for much of the overcharges.  Many top executives at the BMV were aware of these problems but chose to not do anything about them. Rumors have said that it was because the BMV did not wish to suffer any budget shortfalls. Governor Mike Pence had the state's contract with Express MVA cancelled in August 2015. Inspector General Cynthia Carrasco was asked by Governor Pence to investigate the matter. Today it the $500 settlement was revealed to the public. The staff here at Indy Republican cannot figure out why any fine was levied at all if the only thing Walters is going to get is a $500 wrist slap!


Julia Vaughan with Common Cause Indiana is quoted as saying the fine "amounts to a slap on the wrist. Five Hundred Dollars is not going to put fear into anybody. It's not significant enough punishment to get anybody's attention or to make them take these laws seriously."


It's interesting that the article points out that the ethics case in question did not address Walters part in the multi million dollar overcharges to Hoosier motorists. Neither Shawn Walters or his attorney Debra Minott (who strangely was Walters employer when she was in charge of FSSA) were present at the hearing today. Some readers may recall that Debra Minott was appointed by Governor Pence to run FSSA shortly after he took office and was then mysteriously removed from her position at FSSA for reasons that are still not clear. Before her 18 month tenure as head of FSSA Minott was in charge of the State Personnel Department (SPD) during the first term of former Governor Mitch Daniels and also left that position for unspecified reasons. Minott's appointment as FSSA Secretary was a move that angered many Indiana Republicans who were left asking ourselves Why in the world is Mike Pence stupid enough to appoint a Mitch Daniels crony to run FSSA after the mess she caused at SPD? Gary Welsh pointed out that Mike Pence did not cause the overcharging problems at the BMV that occurred under the administration of Mitch Daniels. But apparently neither the Indianapolis Star or Matt Tully's Circle Jerk Club as Gary Welsh so affectionately refereed to him and his clique as. Would trouble themselves enough to hold Daniels feet to the fire! They all were probably admiring themselves too much in the mirror or social climbing!


But for all the trouble that "Napoleon Mitch" Daniels caused at the BMV. Mike Pence deserves as much blame for his refusal to fire every Daniels holdover and heed the advice of Real Republicans Gary Welsh, Paul Ogden, and Charlie White. Men who tried to do the right thing and try to root out corruption, sin and vice. But the Uber-Christian Mike Pence seems to be so convinced of his own moral righteousness that he cannot or will not see the corruption going on in front of his face or do anything to root it out! No doubt the scandals at the BMV have been archived away by Indiana Democrats for use against Pence in the upcoming Governor's race where he is being challenged by former Indiana State House Speaker John Gregg. For the simple reason that Mike Pence has repeatedly kept Mitch Daniels hacks and parasites in his administration is enough cause for all of us at Indy Republican to refuse to endorse him for reelection as Governor of for election to any other office whatsoever! The staff will not vote for Pence or Gregg and at this point are probably just going to refuse to vote for any candidate running for Governor! To Governor Mike Pence if there is any awareness left in your brain at all could you please for your own sake and what remains of your reputation start actually doing your job! For those of you who wish to peruse the story that most of the Indianapolis Press will not tell you about the BMV the staff refers you to the following articles, post's and podcasts for the truth!
